Comment (by me): Lawyers and clients should both pay attention; you can minimize a case that doesn’t help you, but you should discuss it and tell the court why it shouldn’t apply. How can a court with all its cases do their own research? They cannot. Lawyers provide that duty of candor so the court can make a just decision.
